收到你们提出的《关于治理整顿校园欺凌现象的提案》后我厅高度重视,组织治安部门逐条分析研究,现立足公安职能,将我厅办理情况答复如下:
根据教育部、公安部等11个部门联合印发的《加强中小学生欺凌综合治理方案》(教督201710号,以下简称《方案》),中小学生欺凌是指发生在校园(包括中小学校和中等职业学校)内外、学生之间,一方(个体或群体)单次或多次蓄意或恶意通过肢体、语言以及网络等手段实施欺负、侮辱,造成另一方(个体或群体)身体伤害、财产损失或精神损害等事件。《方案》明确指出,学生欺凌事件的处置以学校为主,但对情节比较恶劣、对被欺凌学生身体和心理造成明显伤害的严重欺凌事件,学校可邀请公安机关参与警示教育或对实施欺凌学生予以训诫;对涉及违反治安管理或者涉嫌犯罪的学生欺凌事件,处置以公安机关、人民法院、人民检察院为主。
近年来,我厅会同教育部门,积极采取有效措施预防校园欺凌和暴力事件。2017年,报请省政府下发了《甘肃省加强中小学幼儿园安全风险防控体系建设实施意见》(甘政办发〔2017〕163号),组织全省公安机关密切协同教育等主管部门,建立健全防控学生欺凌和暴力行为有效机制积极构建党委领导、政府负责、社会协同、公众参与、法治保障科学系统、全面规范、职责明确的学校安全风险预防、管控与处置体系。同年,我厅会同省教育厅联合下发了《关于坚决防止学生欺凌和暴力事件的紧急通知》(甘公警令发〔2017〕92号),要求各地中小学辖区公安派出所、驻校民警切实落实保卫责任,按照中央和我省有关文件精神,会同教育部门对校园安全保卫工作逐项检查,堵塞漏洞,解决安全隐患;在治安情况复杂、问题较多的学校周边设置警务室或治安岗亭,目前全省共设立“护学岗”2781个,通过积极配合学校排查发现、预防处置学生欺凌和暴力隐患苗头,较好地发挥了维护校园安全作用。
在常年不懈开展“护校安园”工作的基础上,我厅结合今年以来校园安全管理工作形势特点和政协提案意见建议,于4月份联合省综治办、省教育厅制定实施了《2018年全省中小学幼儿园“护校安园”专项工作方案》,再次部署全省公安机关开展防治中小学生欺凌工作。
认真开展线索摸排。各级公安机关主动深入排查校园及周边欺凌线索,特别针对易发生校园欺凌等暴力违法行为的职业技术学校和农村中小学等重点学校,加大排查力度,注意发现有黑恶势力、社会闲散人员侵害学生的苗头或迹象;在学校及周边设置校园欺凌举报箱,利用学校全方位、多角度开展宣传,鼓励学生积极举报;加强网上网下线索摸排,加大对学生关注的论坛、网站巡查力度,及时发现涉及学生欺凌线索;对摸排发现的学生欺凌线索,逐一登记、串并梳理、认真核查。
切实加大查处打击。对有欺凌他人倾向或有欺凌他人行为的重点学生,会同教育、学校、家庭因人因情施策,加强教育惩戒,从源头上预防和减少校园欺凌行为的发生;对发生欺凌行为的苗头迹象和不构成违法犯罪的欺凌行为,将线索情况及时移交学校,指导督促校方做好预防处置工作,防止欺凌行为升级;对涉嫌违法犯罪的欺凌行为,会同办案部门及时立案,专案专办,逐案落实办案力量和侦办责任;对后果严重、社会影响恶劣的欺凌案件,通过挂牌督办、上提查办等方式,力争快侦快破。截至目前,共摸排发现学生欺凌线索102条,经核查审定,均达不到校园欺凌案件立案标准,已移交学校并督促做好预防处置工作,全省未发生校园欺凌案件。
大力强化宣传教育。组织各地中小学属地派出所担任法制副校长或法制辅导员的民警多频次次进校园开展预防欺凌和暴力专题教育,通过以案析理、法制宣传,让学生知晓法律底线和行为底线,培养遵纪守法行为习惯,增强自我保护意识和能力,共同抵制不法行为。今年以来,公安机关共派出法制辅导员3748名,开展法制教育2891次。同时,联合省教育厅在全省组织开展了“做自己的首席执行官——平安校园行”主题宣传活动,累计发放宣传手册、宣传海报5万余张,开展以“青少年儿童安全保护”为内容的主题班会1000余节。
四是深入开展治安整治。公安机关坚持把校园及周边作为社会治安重点地区和排查整治工作重点,扎实开展校园及周边治安突出问题整治,在学生上下学重要时段、学生途经重点路段加强巡逻防控和治安盘查,对扰乱教学秩序、侵害师生生命财产安全的违法犯罪活动“零容忍”,对在校园周边地区出没、活动的流氓团伙和黑恶势力露头就打,对强迫学生交“保护费”、敲诈勒索的深入查证,发现有背后组织操纵的坚决摧毁,对校园周边多发的抢劫、抢夺、诈骗师生财物案件一查到底,着力健全校园安全管理长效工作机制,全力为广大师生构筑平安和谐的安全防线。今年以来,共排查校园内部安全隐患753处,整治校园周边治安乱点1387处,排查化解涉校矛盾纠纷93起;破获涉校刑事案件8起,查处涉校治安案件106起,打击处理违法犯罪嫌疑人员193人。
